INTOXIMETER DEFECT: The intoxilyzer EC/IR has two switches which permit one to test a gaseous sample. The one is the switch to set the zero balance; the second is to test for any reactive substance in a sample. If one wants to be sure to get a 0.00 reading, one uses the zero balance switch. For example if one wants to portray hydrogen gas in an air sample as being un-reactive, one would press the zero balance switch. I became aware of this reality when a subject’s breath recorded a 0.00%. Shortly thereafter , the breath was tested again; and showed an illegal amount of alcohol present in the breath sample. The tester obviously had hit the wrong switch

Hydrogen in the breath is unlikely to be as much as 250 ppm of hydrogen in a human breath and this would evidently add not more than a 0.10% reading on the instrument. More common would be about 60 ppm of hydrogen in the breath. Consumption of food between one and ten hours before being tested is when the hydrogen content of the breath is likely to be higher than usual. Reporting on this in a trial may end up being a whistle blower case, so other may be some risk in exposing the unreliability of the instrument. One the other hand prosecutors may just cancel the case.

OTHER DUI CONCERNS: Dr. Schenk has been providing services primarily to defense lawyers for over 3 decades. C. Sherin Singleton, Psy.D., Q.M.E., is a clinical and forensic psychologist with extensive experience in the evaluation and treatment of severely mentally ill adult forensic inpatients. She currently serves as a Staff Psychologist at Patton State Hospital, providing services aimed at restoration of competence to patients deemed incompetent to stand trial by the court.
